谨防鼓励放弃宅基地成为变相强迫农民上楼

text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">宅基地是保障农民安居乐业和农村社会稳定的重要基础，也是农村发展的重要资源，需要保持政策上的相对稳定性。同时，也需要对既有宅基地制度进行改革，包括农民自愿退出宅基地等。</p><p style="box-sizing: border-box; margin-top: 20px; text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">早在2019年9月，中央农办、农业农村部就出台了《关于进一步加强农村宅基地管理的通知》；次年9月，全国104个县（市、区）和3个地级市启动实施新一轮农村宅基地制度改革试点；2022年11月，农业农村部研究起草的《农村宅基地管理暂行办法（征求意见稿）》对外公布；2023年8月，农业农村部就有的全国人大代表有关保障乡村振兴战略下宅基地退出中农民土地权益的建议进行答复（下称《答复》）。</p><p style="box-sizing: border-box; font-size: 18px; text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">几乎一年一个相关措施出台，显示国家层面对宅基地改革的积极推进，也反映出对宅基地改革的审慎。毕竟这关系到亿万农民的切身利益，也关系到社会稳定。</p><p style="box-sizing: border-box; font-size: 18px; text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">新一轮农村宅基地制度改革试点中，探索宅基地自愿有偿退出机制是重要内容之一。改革要求在试点中坚持依法自愿有偿原则，在宅基地退出中充分尊重农民意愿，探索通过公开征求意见、建立协商机制、退出公示等方式，保障农民的知情权、参与权。类似关于自愿的规定在诸多法律法规、政策文件中都有所强调。</p><p style="box-sizing: border-box; font-size: 18px; text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">之所以强调自愿，是因为过去有过“强迫”农民上楼的现象，造成的不良社会影响不可低估。其解决途径就是充分尊重农民对宅基地的所有权、资格权、使用权，确保宅基地所有者的知情权和参与权。</p><p style="box-sizing: border-box; font-size: 18px; text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">需要强调的是，现在和今后都不能将“鼓励”变为变相的“强迫”。过去相当长一段时间，农村宅基地自愿退出的比较少，反而农民由于家乡有宅基地，选择从城里回乡定居的比较多。有的地方出台政策鼓励农民自愿放弃宅基地之后，公众最担心的就是会不会成为另一种形式的强迫农民进城上楼。</p><p style="box-sizing: border-box; font-size: 18px; text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">按照相关规定，宅基地上的房屋等是具备物权性质的，也就是具备价值属性。宅基地本身并不具备这种价值属性。但一些地方给宅基地“定了价”，奖补在5万元左右不等，并且附加了条件，需要到指定区域购房才能获得奖补。这勉强可以说是体现了“有偿”，但是否“公平”存在很大疑问。</p><p style="box-sizing: border-box; margin-top: 20px; margin-bottom: 20px; padding: 0px; border: 0px; color: rgb(34, 34, 34); font-family: PingFang SC, Hiragino Sans GB, Microsoft YaHei, WenQuanYi Micro Hei, Helvetica Neue, Arial, sans-serif; font-size: 18px; text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">没有一个合理公平的定价机制，就会助长一些地方政策出台的随意性，会损害宅基地所有者的权益。上述《答复》明确，要重点推动完善宅基地退出补偿机制，建立更加科学的宅基地和农房价格评估体系，总结形成一批可复制推广的实践成果。“建立更加科学的宅基地和农房价格评估体系”，是体现公平原则的重要基础。</p><p style="box-sizing: border-box; font-size: 18px; text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">宅基地改革的重要目的是促进宅基地节约集约利用，但有的地方并不完全是出于这样的考虑，而是基于土地财政算了一笔“聪明账”：以相对低价“鼓励”农民退出宅基地，实现占补平衡，取得土地使用指标，然后再高价卖地，缓解财政紧张局面；而放弃了宅基地的农民，一部分会选择到城市购房，又会对消化楼市库存起到促进作用。</p><p style="box-sizing: border-box; margin-top: 20px; margin-bottom: 20px; padding: 0px; border: 0px; color: rgb(34, 34, 34); font-family: PingFang SC, Hiragino Sans GB, Microsoft YaHei, WenQuanYi Micro Hei, Helvetica Neue, Arial, sans-serif; font-size: 18px; text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">有的地方出台政策，农民自愿放弃宅基地并进城购房，在原宅基地归还村集体用于复耕复垦并拆除建（构）筑物后才给予奖补。试想，宅基地面积不大，并且退出的宅基地也难以成片，又如何实现复耕复垦？是要实现“村中地”吗？这显然是在钻耕地红线的空子，和过去有的地方将坑塘填平以增加耕地面积的操作手法并无二致，然而坑塘填平却给内涝造成了隐患。</p><p style="box-sizing: border-box; margin-top: 20px; margin-bottom: 20px; padding: 0px; border: 0px; color: rgb(34, 34, 34); font-family: PingFang SC, Hiragino Sans GB, Microsoft YaHei, WenQuanYi Micro Hei, Helvetica Neue, Arial, sans-serif; font-size: 18px; text-align: justify; text-wrap: wrap; background-color: rgb(255, 255, 255);">总之，农村宅基地改革是大方向，要以探索宅基地所有权、资格权、使用权“三权分置”为重点，遵循自愿、公平有偿、有效利用的原则，而不是以促进房地产健康发展、去库存为出发点，损害宅基地所有者权益，要避免让“鼓励”放弃宅基地成为变相“强迫”农民上楼。</p><p style="box-sizing: border-box;
