text-align: justify; color: rgb(51, 51, 51); font-family: SF Pro SC, SF Pro Text, SF Pro Icons, Helvetica Neue, Helvetica, Microsoft YaHei, 微软雅黑, serif; font-size: 18px; background-color: rgb(255, 255, 255);">2024年6月12日、13日，我局综合执法大队执法人员领取了国家食品安全智慧监管系统核查处置平台下发的编号咸食药检（2024）SPXQ0514、S2401960不合格检验报告，内容标称富平县王寮镇太平美香粉条加工厂生产的粉条经抽样检验，铝的残留量（干样品，以Al计）项目不符合GB 2760-2014《食品安全国家标准 食品添加剂使用标准》要求，检验结论为不合格。</p><p style="box-sizing: border-box; margin-top: 0px; margin-bottom: 14px; padding: 0px; text-wrap: wrap; line-height: 1.75; text-indent: 2em; text-align: justify; color: rgb(51, 51, 51); font-family: SF Pro SC, SF Pro Text, SF Pro Icons, Helvetica Neue, Helvetica, Microsoft YaHei, 微软雅黑, serif; font-size: 18px; background-color: rgb(255, 255, 255);">（二）核查处置情况</p><p style="box-sizing: border-box; margin-top: 0px; margin-bottom: 14px; padding: 0px; text-wrap: wrap; line-height: 1.75; text-indent: 2em; text-align: justify; color: rgb(51, 51, 51); font-family: SF Pro SC, SF Pro Text, SF Pro Icons, Helvetica Neue, Helvetica, Microsoft YaHei, 微软雅黑, serif; font-size: 18px; background-color: rgb(255, 255, 255);">经查，当事人于2023年12月12日共生产20袋粉条，规格均为500克/袋；2024年04月17日共生产105袋粉条，规格均为2.5千克/袋，500克/袋的粉条售价8元，2.5千克/袋粉条的售价33元。至案发，2.5千克/袋粉条退回81袋，其他均已售完，违法所得907元。案发后，当事人将退回粉条粉碎，再生产时将粉碎粉条回炉再造，并且分析了粉条中铝超标的原因、制定了整改报告、及时发布关于涉案批次不合格产品召回公告。至召回公告截止日止，召回数为0，期间未接到有消费者因食用上述批次粉条有不良反应的报告。当事人生产超限量使用食品添加剂食品的违法行为违反了《陕西省食品小作坊小餐饮及摊贩管理条例》第十二条第（八）项：“《中华人民共和国食品安全法》第三十四条的禁止性规定”、《中华人民共和国食品安全法》第三十四条第（四）项：“禁止生产经营下列食品、食品添加剂、食品相关产品：……(四)超范围、超限量使用食品添加剂的食品;……”的规定；依据《陕西省食品小作坊小餐饮及摊贩管理条例》第四十七条第二款：“违反本条例第十二条第(七)项、第(八)项规定的，由县级以上食品药品监督管理部门没收违法所得和违法生产经营的食品，并可以没收用于违法生产经营的工具、设备、原料等物品;情节严重的，责令停产停业，或者由原发证部门吊销许可证或者注销登记卡;违法生产经营的食品货值金额不足一千元的，对食品小作坊、小餐饮生产经营者并处五千元以上二万元以下罚款，对食品摊贩并处五百元以上二千元以下罚款;货值金额一千元以上的，对食品小作坊、小餐饮生产经营者并处货值金额十倍以上二十倍以下罚款，对食品摊贩并处二千元以上一万元以下罚款。”的规定予以处罚。</p><p style="box-sizing: border-box; font-size: 18px; background-color: rgb(255, 255, 255);">鉴于当事人案发后积极配合调查，及时发布召回公告并积极整改，主动消除危害后果，经调查核实当事人并无主观故意，且至本案调查终结，我局也未收到有关当事人销售不合格食品的投诉举报，符合《行政处罚法》第三十二条第（一）项“当事人有下列情形之一，应当从轻或者减轻行政处罚：（一）主动消除或者减轻违法行为危害后果的；……”之规定。</p><p style="box-sizing: border-box; text-align: justify; color: rgb(51, 51, 51); font-family: SF Pro SC, SF Pro Text, SF Pro Icons, Helvetica Neue, Helvetica, Microsoft YaHei, 微软雅黑, serif; font-size: 18px; background-color: rgb(255, 255, 255);">经查，当事人于2024年05月13日从富平县王寮镇太平美香粉条加工厂采购了100袋涉案粉条，进购价格为32元/袋，销售价格为36.9元/袋。截止案发，当事人已于2024年05月30日向供货商退回81袋，共销售了19袋，货值金额共计608元。当事人认真履行了进货查验义务，索取了涉案粉条的《检验报告》、进货票据、供货者的《营业执照》、《小作坊生产许可证》等证明粉条来源、品质的资料，不知道涉案粉条不符合食品安全标准。当事人经营超限量使用食品添加剂食品的违法行为违反了《中华人民共和国食品安全法》第三十四条第（四）项：“禁止生产经营下列食品、食品添加剂、食品相关产品：……(四)超范围、超限量使用食品添加剂的食品;……”的规定；依据《中华人民共和国食品安全法》第一百三十六条：“食品经营者履行了本法规定的进货查验义务，有充分证据证明其不知道所采购的食品不符合食品安全标准，并能如实说明其进货来源的，可以免于处罚，但应当依法没收不符合食品安全标准的食品；造成人身、财产或者其他损害的，依法承担赔偿责任。”</p><p style="box-sizing: border-box;
