font-size: 18px; background-color: rgb(255, 255, 255);">2024年7月12日,我局综合执法大队执法人员领取了国家食品安全智慧监管系统核查处置平台下发的编号№:XASP202404017不合格检验报告，内容为富平县稼麦酿造有限公司生产的香醋经抽样检验，菌落总数项目不符合GB14884-2016《食品安全国家标准蜜饯》要求，标准指标n=5,c=2,m=10³,M=10⁴实测值1.5×10³，1.2×10³，1.5 ×10³，1.6×10³，1.9×10，检验结论为不合格。</p><p style="box-sizing: border-box; text-align: justify; color: rgb(51, 51, 51); font-family: SF Pro SC, SF Pro Text, SF Pro Icons, Helvetica Neue, Helvetica, Microsoft YaHei, 微软雅黑, serif; font-size: 18px; background-color: rgb(255, 255, 255);">经查，现场未发现抽检不合格批次香醋。经核查，该批次香醋生产日期为2023年11月1日，香醋规格型号2.5L/瓶，共生产100瓶，截止检查前90瓶已销售，5瓶送检第三方检验机构，5瓶该公司自行进行出厂检验。销售了15件，每件6瓶，每件销售价是23元，违法所得共345元。当事人提供了生产销售相关台账记录，收到不合格检验报告后，当日发布不合格香醋的召回公告。至召回公告截止日止，召回数量为0 ，期间未接到消费者因食用该批次香醋不良反应的报告。当事人生产不符合食品安全标准的香醋的违法行为违反了《中华人民共和国食品安全法》第三十四条第(十三)项“禁止生产经营下列食品、食品添加剂、食品相关产品:(十三)其他不符合法律、法规或者食品安全标准的食品、食品添加剂、食品相关产品。”之规定。</p><p style="box-sizing: border-box; font-size: 18px; background-color: rgb(255, 255, 255);">依据《中华人民共和国食品安全法》第一百二十四条第二款“除前款和本法第一百二十三条、第一百二十五条规定的情形外，生产经营不符合法律、法规或者食品安全标准的食品、食品添加剂的，依照前款(违反本法规定，有下列情形之一，尚不构成犯罪的，由县级以上人民政府食品药品监督管理部门没收违法所得和违法生产经营的食品、食品添加剂，并可以没收用于违法生产经营的工具、设备、原料等物品;违法生产经营的食品、食品添加剂货值金额不足一万元的，并处五万元以上十万元以下罚款;货值金额一万元以上的，并处货值金额十倍以上二十倍以下罚款;情节严重的，吊销许可证。)规定给予处罚。”之规定给予行政处罚。</p><p style="box-sizing: border-box; font-size: 18px; background-color: rgb(255, 255, 255);">鉴于当事人初次违法，违法行为持续时间较短，履行了生产销售记录制度，案发后积极配合案件调查，提供相关证据材料并及时整改，经调查核实当事人并无主观故意，截至本案调查终结，我局未收到针对当事人销售不合格香醋的相关投诉举报，社会危害性较小。符合《陕西省市场监督管理局行政处罚裁量权适用规则(修订)》第十一条“有下列情形之一的，可以减轻或者从轻行政处罚:(三)积极配合市场监管部门查处违法行为，如实陈述违法事实并主动提供证据材料的”……之规定。</p><p style="box-sizing: border-box;
