2px;">为认真贯彻落实习近平总书记关于安全生产重要论述，坚持人民至上、生命至上，坚持安全第一、预防为主，按照安全生产治本攻坚三年行动总体要求，进一步落实生产经营单位全员安全生产责任制，提高事故隐患自查自纠能力，依据《中华人民共和国安全生产法》《陕西省安全生产条例》《国务院安全生产委员会关于推动建立完善生产经营单位事故隐患内部报告奖励机制的意见》（安委〔2024〕7号）等相关法律、法规和制度要求，制定本办法。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><strong><span style="letter-spacing: 2px;">第二条 </span></strong><span style="letter-spacing: 2px;">生产经营单位内部事故隐患报告奖励是指生产经营单位内部建立相应工作机制，促进本单位隐患早发现、早处置、早消除，激励、奖励内部从业人员发现并报告身边的事故隐患、提出合理化整改建议。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;">2025年6月底前，推动煤矿、非煤矿山、石油天然气开采、化工（含石油化工）、医药、危险化学品、烟花爆竹、交通运输（含道路、铁路、民航、水上交通运输、城市轨道交通）、建筑施工（含隧道施工）、民用爆炸物品、燃气、渔业船舶、工贸、电力等重点行业领域的生产经营单位建立并实施事故隐患内部报告奖励机制；2025年底前，推动其他行业领域生产经营单位建立并实施事故隐患内部报告奖励机制。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><strong><span style="letter-spacing: 2px;">第三条 </span></strong><span style="letter-spacing: 2px;">生产经营单位是本单位内部事故隐患报告奖励工作的责任主体，生产经营单位负责人负责建立健全相应工作机制、畅通报告渠道、保障奖励资金，及时核查整改从业人员报告的事故隐患，落实安全生产责任。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><strong><span style="letter-spacing: 2px;">第四条 </span></strong><span style="letter-spacing: 2px;">从业人员是指该单位从事生产经营活动各项工作的所有人员，包括管理人员、技术人员和各岗位工人，也包括生产经营单位临时聘用的人员和被派遣劳动者。鼓励生产经营单位从业人员在报告事故隐患的同时，提出整改的合理化建议。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><strong><span style="letter-spacing: 2px;">第五条 </span></strong><span style="letter-spacing: 2px;">省市县人民政府应当加强对生产经营单位建立健全内部事故隐患报告奖励机制工作的领导。省市县人民政府有关部门负责推动各自职责范围内有关行业领域生产经营单位开展工作，指导帮助生产经营单位切实提升事故隐患自查自纠能力和安全水平。</span></p><p><br/></p><section style="-webkit-tap-highlight-color: style="letter-spacing: 2px;">生产经营单位应当结合落实全员安全生产责任制，建立健全事故隐患报告奖励机制，明确受理部门、工作流程、奖励标准和整改程序。对从业人员报告岗位职责内的事故隐患经查实后按标准予以奖励；对从业人员报告岗位职责外的事故隐患经查实后提高奖励标准。对从业人员报告事故隐患直接避免了伤亡事故发生或重大财产损失的，应当予以特别奖励。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><strong><span style="letter-spacing: 2px;">第七条 </span></strong><span style="letter-spacing: 2px;">生产经营单位应当明确受理从业人员报告事故隐患的途径，简化报告程序、畅通报告渠道。要采用内部信息化系统、电话、微信、电子邮箱等多种受理方式并向全员公示有关信息，确保从业人员普遍知晓隐患和危害报告途径，同一处隐患多次报告的只奖励首次报告人。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><strong><span style="letter-spacing: 2px;">第八条 </span></strong><span style="letter-spacing: 2px;">生产经营单位应当鼓励从业人员重点报告以下情况：</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;">1.人的不安全行为。包括从业人员违反安全规章制度的行为、不执行安全生产指令、不正确使用个人劳动保护用品、违反劳动纪律；管理人员强令冒险作业、违章指挥、擅自变更安全工艺和操作程序、指挥未经安全培训的劳动者或无相应资格人员作业等。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;">2.设施设备的不安全状态。包括未按相关规范标准设置安全警示标志；安全设备的设计、制造、安装、使用、检测、维修、改造和报废，不符合国家标准或者行业标准；未对安全设备进行经常性维护、保养，并定期检测；关闭、破坏直接关系生产安全的监控、报警、防护、救生设备、设施，篡改、隐瞒、销毁相关数据、信息等。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;">3.环境的不安全因素。包括作业场所未依法办理相关审批或许可，对作业场所风险评估不足，未对作业场所进行风险监测并设置有效的安全保障，对作业场所事故隐患整改不到位；进行有限空间作业、爆破、吊装、动火、临时用电以及其他危险作业，未按规定落实安全措施等。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;">4.安全管理存在的缺陷和漏洞。包括未按规定排查整治本单位重大事故隐患；未建立和落实本单位全员、岗位安全生产责任制和操作规程，未制定并实施本单位安全生产教育和培训计划、生产安全事故应急救援预案，未开展应急演练；特种作业人员未持证上岗；将生产经营项目、场所发包或者出租给不具备安全生产条件或者相应资质的单位或者个人；转包和违法分包施工情形，以及外包作业安全管理方面存在的问题隐患等。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><strong><span style="letter-spacing: 2px;">第九条 </span></strong><span style="letter-spacing: 2px;">生产经营单位对从业人员报告的事故隐患，应当及时组织核查，核查属实的，应当立即整改；对存在重大事故隐患不能立即整改的，应当落实整改责任人、措施、资金、期限和应急措施并按分级和属地原则向负有安全监管职责的部门报告。从业人员报告的事故隐患应列入生产经营单位隐患排查治理台账，实行闭环管理。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><strong><span style="letter-spacing: 2px;">第十条 </span></strong><span style="letter-spacing: 2px;">生产经营单位应当加强内部事故隐患报告奖励工作的宣传引导，提高从业人员发现问题和解决问题的能力和意愿；应当强化培训，提升从业人员对本单位、本岗位安全风险和事故隐患的辨识能力；应当明确告知从业人员，对报告的重大事故隐患不予整改或者谎报瞒报生产安全事故、有安全生产违法行为的，从业人员有权向政府有关部门举报。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><strong><span style="letter-spacing: 2px;">第十一条 </span></strong><span style="letter-spacing: 2px;">生产经营单位应当按照《企业安全生产费用提取和使用管理办法》等规定，在安全生产费用中安排从业人员发现报告事故隐患的奖励资金。符合生产经营单位安全生产费用提取和使用范围的资金，按照相关规定在成本中据实列支。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="letter-spacing: 2px;"><br/></span></p><p style="text-indent: 2em;line-height: 2em;"><strong><span style="letter-spacing: 2px;">第十二条 </span></strong><span style="letter-spacing: 2px;">生产经营单位应当加强对本单位从业人员报告隐患情况的分析，研判安全管理存在的共性和事故隐患特点，及时采取针对性措施加以改进，切实提升本质安全水平。</span></p><p><br/></p><section style="-webkit-tap-highlight-color: transparent;margin-bottom: unset;outline: style="letter-spacing: 2px;"> 各级有关政府部门应当加大生产经营单位内部事故隐患报告奖励工作的宣传力度，引导生产经营单位将事故隐患辨识标准及内部奖励制度纳入安全教育培训内容，提高从业人员主动查找和报告事故隐患的积极性，切实预防各类事故的发生。</span></section><p><br/></p><section
