为了加强农业机械管理，维护农业机械生产、经营和使用者的合法权益，加快发展农业机械化，促进农业和农村经济发展，根据有关法律、法规，结合本省实际，制定本条例。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: 本条例所称农业机械，是指用于农业生产及其产品初加工等相关农事活动的机械、设备。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第三条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 本条例适用于本省行政区域内从事农业机械科研、生产、鉴定、销售、推广、使用、维修和人员培训、监督管理的单位和个人。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第四条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 农业机械的使用和管理应当遵循因地制宜、方便生产、提高效率、确保安全和推广农业机械新技术、提高农业机械社会化服务水平的原则。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第五条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 各级人民政府应当加强对农业机械化工作的领导，将农业机械化事业纳入国民经济和社会发展规划，增加农业机械化投入，扶持农业机械的科研、生产和推广。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">鼓励各种组织和个人投资、发展农业机械化事业。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">县级以上人民政府或者省农业农村主管部门对在农业机械化事业中做出显著成绩的单位和个人，可以按照国家有关规定给予表彰和奖励。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二章 管理和创新</span></strong></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第六条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 县级以上农业农村主管部门负责本行政区域内的农业机械管理和监督工作。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">林业、水利等部门按照各自的职责，负责本系统农业机械的使用管理工作。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">科技、工业和信息化、公安、交通运输、市场监督管理等部门，负责各自职责范围内的农业机械管理工作。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第七条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 县级以上农业农村主管部门的主要职责是：</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（一）负责宣传、贯彻有关农业机械的法律、法规；</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（二）制定辖区内农业机械化发展规划并组织实施，指导农业机械化服务体系建设；</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（三）按规定负责农业机械的生产、鉴定和安全监督管理，产品质量的行业监督管理；</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（四）负责农业机械化科学研究、技术推广和教育培训；</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（五）组织机械化农业生产、负责农业机械化作业质量监督和农业机械维修管理；</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（六）负责农业机械化统计和资金、物资的管理；</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（七）法律、法规规定的其他事项。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第八条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 乡镇人民政府、街道办事处的职责是：</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（一）宣传、示范和推广农业机械先进机具及使用技术；</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（二）指导农业机械服务组织（户）开展社会化服务；</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（三）组织农业机械的适用技术培训，提供农业机械信息服务；</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（四）负责本乡镇、街道办事处农业机械化统计工作；</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">（五）协助县级农业农村主管部门进行农业机械安全及作业质量的监督管理。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第九条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 各级人民政府应当鼓励和支持科研单位和生产企业根据本地农业和农村经济发展的需求，研究开发和引进先进、适用的农业机械及技术。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">鼓励和支持科研单位和科研人员，以科研开发、科研成果转让和科研成果投资入股等方式促进农业机械科研成果的转化。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第十条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 农业机械生产企业对其生产的产品质量负责。农业机械产品应当符合国家规定和认可的质量标准。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">禁止生产国家明令淘汰的农业机械产品和不符合质量标准的农业机械产品。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">因生产的农业机械产品不符合质量标准而给销售者或使用者造成人身伤害和财产损失的，生产企业应当承担相应的法律责任。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第十一条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 国家实行工业生产许可证管理的农业机械产品，生产企业必须取得生产许可证后方可生产。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第十二条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 省人民政府支持推广的先进适用的农业机械产品目录由省农业农村主管部门会同省财政部门、经济综合宏观调控部门确定、公布，并定期调整。列入目录的产品，应当经农业机械生产者自愿提出申请，并通过农业机械试验鉴定机构进行的先进性、适用性、安全性和可靠性鉴定。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">鼓励结合我省果业、畜牧业、茶叶、蔬菜等主导产业和高标准农田建设，研发推广适地化、适产业化农业机械。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第三章 销售、使用和维修</span></strong></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第十三条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 农业机械产品不符合质量要求的，农业机械生产者、销售者应当负责修理、更换、退货。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">因农业机械存在缺陷造成他人损害的，受害人可以向农业机械的生产者要求赔偿，也可以向农业机械的销售者要求赔偿。属于生产者责任的，销售者赔偿后有权向生产者追偿。属于销售者责任的，生产者赔偿后有权向销售者追偿。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第十四条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 农业机械生产者、销售者应当对其生产、销售的农业机械产品质量负责，并按照国家有关规定承担零配件供应和培训等售后服务责任。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">农业机械销售单位和个人必须执行国家价格管理的规定，对所销售的农业机械产品实行明码标价。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第十五条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 农业机械产品质量检验机构可以根据市场监督管理部门的委托，对农业机械产品进行质量监督检验。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第十六条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 农业机械维修经营者，应当具备与维修业务相适应的维修场地，有必要的维修设施、设备和检测仪器，配备相应的维修技术人员，有安全防护和环境保护措施。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第十七条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 农业机械维修经营者应当执行国家标准，确保维修质量。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">维修质量不合格的，维修者应当免费重新修理；造成人身伤害或者财产损失的，应当承担相应的法律责任。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第四章 安全监督</span></strong></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第十八条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 拖拉机、联合收割机实行登记制度，经所在地县级农业农村主管部门依法登记后，方可使用。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第十九条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 驾驶实行登记制度的农业机械驾驶人，应当依照国家规定取得相应的驾驶证。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">换发农业机械驾驶证时，农业农村主管部门应当对农业机械驾驶证进行审验。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二十条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 农业机械驾驶、操作人员应当严格执行农业机械安全操作规程，自觉接受县级以上农业农村主管部门的监督检查。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二十一条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 禁止使用拖拉机、联合收割机从事客运和违法载人；禁止驾驶、操作不符合安全规定的农业机械；禁止酒后驾驶、操作农业机械。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二十二条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 县级以上农业农村主管部门应当对农业机械的驾驶、操作人员进行安全教育，开展安全检查，依法纠正违法行为。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二十三条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 在道路以外发生的农业机械事故，操作人员和现场其他人员应当立即停止作业或者停止农业机械的转移，保护现场，造成人员伤害的，应当向事故发生地农业农村主管部门报告；造成人员死亡的，还应当向事故发生地公安机关报告。造成人身伤害的，应当立即采取措施，抢救受伤人员。因抢救受伤人员变动现场的，应当标明位置。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">接到报告的农业农村主管部门和公安机关应当立即派人赶赴现场进行勘验、检查，收集证据，组织抢救受伤人员，尽快恢复正常的生产秩序。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第五章 社会化服务和保障</span></strong></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二十四条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 各级人民政府应当采取措施，鼓励和扶持发展多种形式的农业机械服务组织，推进农业机械化信息网络建设，完善农业机械化服务体系。农业机械服务组织应当根据农民、农业生产经营组织的需求，提供农业机械示范推广、实用技术培训、维修、信息、中介、租赁等社会化服务。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二十五条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 县级以上农业农村主管部门应当加强农业机械服务信息、技术咨询、人员培训和维修等方面的指导和服务。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二十六条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 农业机械新技术、新产品的推广，按照试验、示范、推广的程序进行。推广的农业机械新产品，应当依法在推广地区试验证明具有先进性和适用性。</span></span></section><section style="margin-left: 0;text-indent: 2em"><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">推广农业机械新技术、新产品，必须坚持自愿原则。任何组织和个人不得强迫农民和农业生产经营组织使用或者购买其指定的农业机械技术或者农业机械产品。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二十七条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 省人民政府财政部门应当安排专项资金，对农民和农业生产经营组织购买国家支持推广的先进适用的农业机械给予补贴。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二十八条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体"> 从事农业机械作业服务的农机经营者和使用者必须执行国家和本省规定的作业质量标准；国家和本省没有制定标准的，应当按照双方签订的作业合同或协议约定的标准执行。</span></span></section><section style="margin-left: 0;text-indent: 2em"><strong><span style="font-family: 思源黑体;color: rgb(38, 19, 19);letter-spacing: 2px;font-size: 17px">第二十九条</span></strong><span style=";font-family:Calibri;letter-spacing:2px;font-size:17px"><span style="font-family:宋体">
