</strong>为规范全省中小学、幼儿园（以下统称“学校”）学生和教职工集中用餐管理，保障食品安全与营养健康，根据《中华人民共和国食品安全法》《学校食品安全与营养健康管理规定》（教育部 国家市场监督管理总局 国家卫生健康委员会令第45号）等有关法律法规和规定，制定本办法。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第二条</strong><strong> </strong>本办法适用于普通中小学校（含教育部门举办的中等职业学校）、幼儿园和专门学校。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第三条</strong> 本办法所称集中用餐指学校通过食堂（伙房）供餐（包括自主经营供餐、承包经营供餐）或校外供餐（包括企业供餐、临近学校食堂配餐及外购食品）等模式，集中向学生和教职工提供食品的行为。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第四条</strong><strong> </strong>学校食堂，指学校为学生和教职工提供就餐服务，具有相对独立的原料存放、食品加工制作、食品供应及就餐空间的场所。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第五条</strong><strong> </strong>自主经营，指学校直接管理经营食堂，包括自办、引进档口、聘请餐饮服务团队等。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第六条</strong> 学校集中用餐遵循预防为主、全程监控、属地管理、学校落实的原则，建立多部门分工负责、合力共治工作机制。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第七条</strong><strong> </strong>学校集中用餐应当坚持公益便利的原则，各地各学校应建立健全制度机制，围绕采购、验收、贮存、加工、配送、供餐、消毒、虫鼠害防治、成本核算、食品安全、信息公开等关键环节进行闭环管理，做到管理规范、价格合理、源头可溯、安全卫生、营养健康。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第八条</strong><strong> </strong>坚持自愿性原则，走读生可自愿选择就餐，寄宿制学校寄宿生原则上在学校食堂就餐。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第九条</strong> 学校应开展食品安全、营养健康、粮食节约、反食品浪费等宣传教育。</span></p><p </strong>县级（含）以上人民政府依法统一领导、组织、协调学校食品安全、膳食经费监管和食品安全突发事件应对等工作，列入议事日程定期研究。相关领导落实校园食品安全包保责任，加强日常督促指导，排查解决校园食品安全风险隐患。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第十一条</strong><strong> </strong>县级人民政府是公办学校集中用餐责任主体，负责投资建设、改造学生食堂，按比例足额配齐工作人员并妥善落实工资及福利，保障水电气暖等能源供应和食堂设施设备补充，统筹安排日常运行经费。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第十二条</strong><strong> </strong>各级各有关部门共同参与学校食堂监管，各司其职、各负其责。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> （一）教育部门加强对食堂建设投入、经营管理、食品安全、膳食经费、食材采购、餐食供应、校外供餐单位确定等工作的统筹管理和指导，明确本单位各业务部门职责，制定并完善食堂运营、招投标、经费管理、评议评价、监督检查、应急处置等制度机制。组织教育培训，加强队伍建设，督促学校定期开展食品安全突发事件应急演练并指导做好应急处置，每年选取一定比例的学校开展内部审计。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> （二）发展改革部门支持新建、改扩建学校食堂项目审批、建设，指导学校合理制定伙食费标准和成本分摊。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> （三）财政部门完善相关投入政策，加强经费预算和使用，严格膳食经费、伙食费和采购监管，发现和查处违反财经纪律行为。营养改善计划实施学校自主经营食堂（伙房）供餐增加的聘用人员待遇等开支纳入同级财政保障范围；其他义务教育公办学校自主经营食堂聘用人员待遇开支，原则上纳入同级财政保障。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> （四）审计部门加强审计监督，结合审计项目计划开展审计。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> （五）人力资源和社会保障部门配合教育行政部门指导学校做好食堂从业人员配备、合同签订、工资福利待遇等保障工作。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> （六）农业农村部门强化源头管控，加强区域内直供学校食用农产品生产环节质量监管和肉类产品屠宰环节检疫检验，保障直供学校农产品质量安全。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> （七）卫生健康部门加强校园食品安全风险和营养健康监测评估，对学生营养膳食和预防食源性疾病提出指导意见，加强餐具、饮具集中消毒服务单位监督。指导学校开展传染病防控和营养健康学校建设相关工作。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> （八）市场监管部门加强监督管理，严格承包经营、食材供应、供餐等经营主体准营许可，及时查处违法行为，建立校园食品安全信用档案，指导学校做好食品安全管理、宣传教育和突发事件应急处置，常态化开展食材价格监督检查。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> （九）公安机关严厉打击采购围标串标、校园食品安全违法犯罪行为。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第十三条</strong><strong> </strong>学校履行食堂管理主体责任，成立食堂管理领导小组，每学期至少专题研究部署1次食品安全和膳食经费管理工作。落实校园食品安全和膳食经费管理校长负责制，每学期至少在食堂主持召开1次现场办公会。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第十四条</strong><strong> </strong>学校应建立食堂内部控制、岗位责任、运营监管、安全生产、信息公开等管理制度，每年至少开展1次制度自查，及时修订完善。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第十五条</strong> 各级教育部门和学校应建立陪餐制度，同餐同价，餐费自理。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> 省级教育部门负责人每季度至少陪餐1次；市、县级教育部门主要负责人每月至少陪餐1次；学校主要负责人每周至少陪餐1次，每餐均有学校相关负责人与学生共同用餐。鼓励学校组织家长轮流预约陪餐。</span></p><p style="line-height: 1.75em;margin-bottom: 15px;"><br/></p></section><section><section </strong>学校食堂应为学生和教职工提供就餐服务（非必需不单独设置教师食堂）。未建设食堂或暂时不具备食堂供餐条件的，应不断改善供餐条件，逐步解决就餐需求；确不具备食堂设置条件的，可依托邻近学校食堂配餐或者遴选有资质的企业（单位）供餐；偏远地区小规模学校（教学点），不具备食堂供餐和配餐条件的，在确保食品卫生和安全的前提下，可实行学校伙房供餐或家庭（个人）托餐。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第十七条</strong><strong> </strong>学校食堂在取得食品经营许可证后方可供餐，结合实际选择包餐制或选餐制供餐；伙房、托餐家庭（个人）经市场监管部门审核后方可供餐。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第十八条</strong> 各地政府按照与就餐学生人数之比不低于1:100的比例（幼儿园1:40~45）为公办学校足额配齐食堂工作人员，不足100人的可适当增加人员。补充人员优先从富余教师中转岗，也可采取购买公益性岗位、劳务派遣等方式从社会公开招聘符合条件的人员。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第十九条</strong><strong> </strong>学校食堂用电、用水、用气价格分别按居民价格执行。</span></p></section><section><section data-role="title" data-tools="135编辑器" <strong>第二十条</strong><strong> </strong>具备食堂供餐条件的学校采用自主经营方式供餐。已承包的，合同到期后由学校管理；由社会投资建设、管理经营的，经当地政府与投资者充分协商取得一致后，由政府购买收回，交学校管理。除实施营养改善计划的义务教育学校外，自主经营确有困难的，经学校集体研究报上级行政主管部门同意后，可承包经营。承包经营食堂不得转包、分包，学校对承包经营企业实行“零租赁”，免收管理费。供餐学校不得随意停止供餐，确需停止供餐的应做好风险评估和后续处置工作，并报上级行政主管部门同意。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第二十一条</strong><strong> </strong>建立成本核算机制。学校食堂遵循成本分摊和补偿原则，以实际耗用的食品原材料、水电气暖及燃料、人工成本、非财政专项资金固定资产折旧、低值易耗品以及零星维修费等各项支出为核算依据。实施营养改善计划的学校从其规定。财政投入的房屋建筑物折旧和其他固定资产折旧以及应由财政保障的人员工资性支出不得计入成本。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第二十二条</strong> 学校自主经营食堂坚持非营利性原则，伙食费标准（饭菜价格）由学校食堂管理领导小组研究制定，实行价格公示制度。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第二十三条</strong> 食堂膳食经费应纳入学校财务分账核算或单独开设账户独立核算。伙食费由学生或家长直接缴入学校指定银行账户。预收的伙食费不得直接计入食堂收入，应按实际就餐次数及金额核算。食堂收支结余用于以丰补欠，改善学生伙食。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第二十四条</strong> 建立评议评价制度。学校应面向学生、教职工和家长，每学期对集中用餐情况开展1次满意度测评，及时查缺补漏；每学年进行1次综合评价（分为优秀、合格、不合格3个等次）。评价不合格的，自主经营食堂限期整改，承包经营食堂终止合同，并向教育、财政和市场监管等部门报告，对违反食品安全法律法规、发生食品安全事件、擅自降低供餐质量标准或随意变更食谱的，列入“黑名单”，禁止参与学校供餐。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第二十五条<strong> </strong></strong>建立信息公开制度。学校在食堂醒目位置设置公告栏或通过学校网站、公众号、APP、微信群等公开食品安全管理、食堂财务收支、伙食费标准（饭菜价格）、每周带量食谱、食材来源及价格、承包经营企业、校外供餐单位等信息，方便公众监督。在食堂显著位置设置公平秤，并进行标识。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第二十六条</strong><strong> </strong>建立统计制度。学校应完整准确填报统计信息，及时更新，定期核准，确保数据真实有效。</span></p></section><section><section data-role="title" （二）新鲜蔬菜、水果、干货、调味品等原辅材料，比照政府采购方式集中采购。偏远地区小规模学校（教学点）经县级教育部门批准，可采取适当的采购方式，并完善相应的采购管理制度，根据符合采购需求、质量和服务相等且报价最低的原则确定成交供应商。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: （五）实施营养改善计划的学校食材采购按《陕西省教育厅等六部门关于印发〈陕西省农村义务教育学生营养改善计划管理办法〉的通知》（陕教规范〔2023〕4号）执行。非实施营养改善计划的民办学校食材采购价格相同或低于上述条件的，可自行采购。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第三十六条</strong><strong> </strong>逐级逐校成立食品安全突发事件应急处置领导小组，制定应急处置预案，联合属地市场监管、疾控及医疗机构定期组织应急演练。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第三十七条</strong> 学校应当配备专（兼）职食品安全管理人员和营养健康管理人员，开展食品安全与营养健康等业务培训。有条件的地区开展膳食营养均衡等咨询指导，推广科学配餐、膳食营养等理念。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第三十八条</strong><strong> </strong>学校应严格控制保健食品、含乳饮料和火腿肠等深加工食品，避免提供高盐、高油、高糖食品，严禁“预制菜”、临期食品进校园，不得制售采用浓浆、浓缩汁、果蔬粉调配成的饮料。</span></p></section><section><p style="line-height: 1.75em;margin-bottom: 15px;"><span style="font-size:16px;"> <strong>第三十九条</strong><strong> </strong>非寄宿制学校不得设置商超（包括商店、超市、小卖部等）经营食品。寄宿制学校确有需要设置的，经上级行政主管部门同意并依法取得许可，按照公益性原则，严格商品售价监管，确保价格明显低于市场零售价。原则上只售卖纯净水、矿泉水、预包装面包、牛奶和新鲜水果等食品以及学习、生活用品。如需增加其他食品销售种类需经学校领导班子和家委会集体讨论同意后方可执行。</span></p></section><section><p 15px;"><span style="font-size:16px;"> <strong>第四十三条</strong> 学校成立膳食监督家长委员会，参与采购、陪餐用餐、质量评价、安全检查、成本核算、收支公开等重大事项监督。适时邀请党代表、人大代表、政协委员和新闻媒体等作为社会监督，参与学校食堂日常监督检查。</span></p></section><section><p
