letter-spacing: 2px; visibility: visible;"><p style="text-indent: 2.25em; visibility: visible;"><span style="font-size: 16px;">《办法》所称农村住房，是指村民在宅基地上自主建设的住宅房屋。农村住房建设包含：村民个人建房，即村民以户为单位，在新增宅基地或原有宅基地上新建、改建、扩建个人住房的行为。统一建房，即村民委员会、村集体经济组织或者其他各种渠道统一组织实施的住房建设。符合当地实际、村民自愿选择的其他建房形式。</span></p><p style="text-indent: 2.25em;"><span style="font-size: 16px;">在设计要求方面，农村住房设计应当满足国家和本省的技术标准。三层以下（不含三层）可以自主设计或者选用农村住房建设通用图集，也可委托具有相应资质的单位出具设计图；三层以上（含三层）应当委托具有相应资质的单位进行设计或选用农村住房建设通用图集。鼓励农村住房设计体现地域、民族和乡土特色，鼓励农村住房建设采用新型建造技术和绿色建材，鼓励村民建设“功能现代、结构安全、成本经济、绿色环保、风貌协调”的现代宜居农房。</span></p><p style="text-indent: 2.25em;"><span style="font-size: 16px;">农村住房占地面积与宅基地面积应比例适当，预留空间能够满足日常生活需要。房屋四至（含滴水）垂直下落投影、台阶均应控制在经批准使用的宅基地范围内。应精心调配空间布局，合理统筹主房、辅房、院落等功能。适应村民现代生活需要，实现产居分离、寝居分离、人畜分离和净污分流。同步设计卫生厕所，因地制宜推动水冲式厕所入室。结合实际需要实施无障碍设施建设。地基基础、结构形式、墙体厚度、建筑构造等要适应当地经济发展水平和建筑施工条件，满足质量安全及抗震设防要求。改建、扩建的农村住房应满足改厨、改厕、改圈、建筑质量、抗震防灾和消防安全要求。</span></p><p style="text-indent: 2.25em;"><span style="font-size: 16px;">在历史文化名城、名镇、名村、传统村落保护范围内的农村住房建设活动，应当符合保护规划和保护方案的要求，不得损害历史文化遗产的真实性和完整性，不得破坏传统格局和历史风貌。</span></p></section><section style="text-align: center;justify-content: center;display: flex;flex-flow: row;margin-top: 10px;margin-bottom: 10px;"><section style="display: inline-block;vertical-align: bottom;width: auto;min-width: 5%;flex: 0 0 auto;height: auto;align-self: flex-end;"><section style="line-height: 0;"><section style="vertical-align: middle;display: inline-block;line-height: 0;width: 25px;height: auto;"></section></section></section><section style="display: inline-block;vertical-align: bottom;width: auto;min-width: 5%;flex: 0 0 auto;height: auto;align-self: flex-end;padding-right: 8px;padding-left: 8px;"><section><section style="text-align: justify;"><p><span style="font-size: 16px;"><strong>经批准后的宅基地两年内必须开建</strong></span></p></section></section><section><section style="background-color: rgb(63, 120, 26);height: 1px;"><svg viewbox="0 0 1 1" style="float:left;line-height:0;width:0;vertical-align:top;"></svg></section></section></section><section style="display: inline-block;vertical-align: bottom;width: auto;align-self: flex-end;flex: 0 0 auto;min-width: 5%;height: auto;"><section style="transform: perspective(0px);transform-style: flat;"><section style="line-height: 0;transform: rotateY(180deg);"><section style="vertical-align: middle;display: inline-block;line-height: 0;width: 25px;height: auto;"></section></section></section></section></section><section style="line-height: 2;letter-spacing: 2px;"><p style="text-indent: 2.25em;"><span style="font-size: 16px;">在建设管理方面，经乡镇人民政府批准后的宅基地，两年内必须开展建设，未开展建设或未按照规划用途使用宅基地的，由村集体经济组织报请乡镇人民政府收回宅基地使用权，但因特殊情况经乡镇人民政府同意延期使用的除外。经批准另址建设农村住房的，在新住房建成后3个月内自行拆除原宅基地上的建筑物、构筑物和其他附着物，并将原宅基地交还村集体。</span></p><p style="text-indent: 2.25em;"><span style="font-size: 16px;">经批准建房的村民，应在农村住房建设工程开工前，向乡镇人民政府提出开工放线申请。乡镇人民政府自受理之日起10个工作日内，组织承担农村住房建设管理工作的机构、村集体经济组织、建房村民和承建方到现场实地丈量批放宅基地，确定坐落、四至、界址等，明确建设要求。未经丈量批放，不得开工。</span></p><p style="text-indent: 2.25em;"><span style="font-size: 16px;">牵头承担农村住房建设工程的乡村建设工匠，应参加乡村建设工匠培训，并取得合格证书。三层以下（不含三层）农村住房建设工程可以委托乡村建设工匠实施。三层以上（含三层）农村住房建设工程必须由具有相应施工资质等级证书的施工单位承担。</span></p><p style="text-indent: 2.25em;"><span style="font-size: 16px;">农村住房建设工程竣工后，村民应提请乡镇人民政府进行竣工验收。自收到申请之日起5个工作日内，由乡镇人民政府组织承担农村住房建设管理工作的机构进行竣工验收，检查农户是否按照批准用地面积、四至边界等要求使用宅基地，是否按照批准建筑面积、风貌和规划要求建设住房，是否按图施工，农村住房质量、抗震、消防是否满足要求。对地质灾害易发区内村民建房，还应检查地质灾害危险性评估报告是否要求配套地质灾害治理工程，如要求配套，需检查地质灾害治理工程是否合格。农村住房经验收合格的，方可交付使用。</span></p></section><p></p><p style="white-space: normal;">点击查看<a href="https://www.dafuping.cn/thread-17433-1-1.html" target="_blank" title="《陕西省农村住房建设管理办法（试行）》">《陕西省农村住房建设管理办法（试行）》</a></p><p style="white-space: normal;">来源：陕西建筑报</p></section></section></section></section><section><section style="width: 5px;
