font-size: 16px;">某某有限公司是一家农资有限公司，经营化肥、种子、农药等农业生产资料。2022年10月，原告某某有限公司与被告杨某某买卖合同纠纷一案，经富平县人民法院审理达成调解协议，法院作出（2022）陕0528民初XXXX号民事调解书，调解书约定被告杨某某分三期向原告某某有限公司偿还29万元货款，若出现任何一笔逾期，则按照349890元履行。调解书生效后杨某某向某某有限公司支付了11万元后再未履行任何款项，原告某某有限公司就下剩款项239890元向富平县人民法院申请强制执行。</span></span></p><p style="text-align: justify;text-indent: 2em;margin-left: 16px;margin-right: 16px;line-height: 1.6em"><span style="font-family: 微软雅黑, Microsoft YaHei;"><strong><span style="font-family: 微软雅黑, Microsoft YaHei; font-size: 16px;">【执行情况】</span></strong><span style="font-family: 微软雅黑, Microsoft YaHei; font-size: 16px;">本案执行立案后经过网络查控系统查询，查明被执行人杨某某名下仅有零星存款，无其他可供执行的财产。</span></span></p><p style="text-align: justify;text-indent: 2em;margin-left: 16px;margin-right: 16px;line-height: 1.6em"><span style="font-family: 微软雅黑, Microsoft YaHei; font-size: 16px;">为了推动案件的顺利执结，承办法官驱车前往被执行人杨某某的住所地核实案件情况并进行村组调查，杨某某见到承办法官后态度亢奋，抵抗情绪非常强烈，认为该案审理时查明事实不清，对账结果错误，自己在毫无法律意识的情况下草草达成了调解协议，侵害了自己的合法权益，拒绝履行民事调解书确定的给付义务。面对被执行人的蛮横态度，承办法官仔细询问了被执行人的家庭情况及面临的困境，让被执行人放下了戒备心，愿意相信办案法官也是在为他化解纠纷排忧解难。其表示自己不是不愿意偿还货款，而是因为经营困难一时间拿不出这么多钱来，而且当时在审理阶段的调解并没有认真核对账目明细，实际欠款并没有那么多，大概只剩下十几万元未履行。</span></p><p style="text-align: justify;text-indent: 2em;margin-left: 16px;margin-right: 16px;line-height: 1.6em"><span style="font-family: 微软雅黑, Microsoft YaHei; font-size: 16px;">考虑到该情况，办案法官传唤了申请执行人，申请执行人虽然陈述了自己经营的企业面临破产歇业等困境以及这些年来催收该笔债务的不易，但也想尽快了结该案，同时也考虑到种种原因决定作出让步。</span></p><p style="text-align: justify;text-indent: 2em;margin-left: 16px;margin-right: 16px;line-height: 1.6em"><span style="font-family: 微软雅黑, Microsoft YaHei; font-size: 16px;">于是办案法官迅速组织双方当事人协商具体解决事宜，最终双方当事人均同意以十五万元了结该案，但申请执行人表示需要被执行人当日一次性付清。不到一个小时，被执行人分两笔向申请执行人支付了十五万元案件款，双方当事人也签署了和解协议，本案执行完毕。</span></p><p style="text-align: justify;text-indent: 2em;margin-left: 16px;margin-right: 16px;line-height: 1.6em"><span style="font-family: 微软雅黑, Microsoft YaHei;"><strong><span style="font-family: 微软雅黑, Microsoft YaHei;
