visibility: visible; font-size: 16px;">债务人将债务的全部或者部分转移给第三人的，应当经债权人同意。本案中被告父亲曾向原告借款20000元，原告在被告父亲病重时，到被告家向被告父亲催要借款，被告根据其父亲授意向原告出具借条，说明被告父亲认可与原告之间存在20000元的借款行为。被告向原告出具的借条中载明被告借到原告秦某人民币20000元，即表示被告取代其父亲成为新的债务人，原告秦某在场接受了该借条，即同意由被告承担债务，构成债务转移，被告应当在约定期限内偿还债务。被告辩称其受胁迫出具借条无证据佐证，且作为完全民事行为能力人，足以认识到出具借条的后果，故对被告所述本院不予认可。关于利息问题，原、被告双方在借条中未约定借期利率及逾期利率，对于原告的利息请求，支持从起诉之日起的逾期利息，按照原告起诉时全国银行间同业拆借中心公布的一年期贷款市场报价利率标准计算。</span></p><p style="margin-right: 16px;text-align: justify;text-indent: 2em;margin-left: 16px;line-height: 1.6em"><span style="font-family: 微软雅黑, Microsoft YaHei; font-size: 16px;">《中华人民共和国民法典》第五百五十一条：债务人将债务的全部或者部分转移给第三人的，应当经债权人同意。债务人或者第三人可以催告债权人在合理期限内予以同意，债权人未作表示的，视为不同意。</span></p><p style="margin-right: 16px;text-align: justify;text-indent: 2em;margin-left: 16px;line-height: 1.6em"><span style="font-family: 微软雅黑, Microsoft YaHei;
