font-size: 18px; background-color: rgb(255, 255, 255); text-wrap-style: inherit !important;"><span style="font-size: 16px;">2025年04月19日，受国家市场监督管理总局委托，长春海关技术中心对当事人生产的鲜羊奶麦胚大饼（饼干）（生产日期：2024-11-05， 规格型号900克/盒）进行食品安全监督抽检；2025年05月22日，我局执法人员在总局食品安全智慧监管系统核查处置平台收到长春海关技术中心出具的编号№：GBJ25000000239130335ZX食品安全监督抽检检验报告，经抽样检验，二氧化硫残留量项目不符合GB 2760-2014《食品安全国家标准食品添加剂使用标准》要求，检验结论为不合格。</span></p><p style="box-sizing: border-box; font-size: 18px; background-color: rgb(255, 255, 255); text-wrap-style: inherit !important;"><span style="font-size: 16px;">经查，当事人共生产标称生产日期为“2024.11.5”的饼干56箱（10千克/箱）共计560千克，全部销售给委托方陕富食品有限公司，批发价为11元/千克。至案发，当事人生产的56箱（560千克）饼干已全部售完，违法所得为6160元。</span></p><p style="box-sizing: border-box; font-size: 18px; background-color: rgb(255, 255, 255); text-wrap-style: inherit !important;"><span style="font-size: 16px;">当事人的上述行为违反了《中华人民共和国食品安全法（2021修正）》 / 第三十四条 / 第四项禁止生产经营下列食品、食品添加剂、食品相关产品：（四）超范围、超限量使用食品添加剂的食品；的规定，构成生产经营超范围、超限量使用食品添加剂的食品的行为。</span></p><p style="box-sizing: border-box; margin-top: 0px; margin-bottom: 14px; padding: 0px; text-wrap-mode: wrap; line-height: 1.75; text-indent: 2em; text-align: justify; color: rgb(51, 51, 51); font-family: SF Pro SC, SF Pro Text, SF Pro Icons, Helvetica Neue, Helvetica, Microsoft YaHei, 微软雅黑, serif; font-size: 18px; background-color: rgb(255, 255, 255); text-wrap-style: inherit !important;"><span style="font-size: 16px;">依据《中华人民共和国食品安全法（2021修正）》/第一百二十四条 /第一款/第三项违反本法规定，有下列情形之一，尚不构成犯罪的，由县级以上人民政府食品安全监督管理部门没收违法所得和违法生产经营的食品、食品添加剂，并可以没收用于违法生产经营的工具、设备、原料等物品；违法生产经营的食品、食品添加剂货值金额不足一万元的，并处五万元以上十万元以下罚款；货值金额一万元以上的，并处货值金额十倍以上二十倍以下罚款；情节严重的，吊销许可证：（三）生产经营超范围、超限量使用食品添加剂的食品；的规定。鉴于当事人违法行为持续时间较短，且案发后积极配合查处。参照《陕西省市场监督管理局行政处罚裁量权适用规则(修订)》第十一条第三项的规定，可以依法减轻处罚。</span></p><p style="box-sizing: border-box;
