-webkit-tap-highlight-color: transparent; padding: 0px; outline: 0px; max-width: 100%; font-size: 16px; box-sizing: border-box !important; overflow-wrap: break-word !important;">代其用筹集的股东股金与一般参赌人员对赌，但该每场股金筹集后，先扣除被告人刘某的“挑头费”、被告人刘某、任某、雷某的“外围费”以及赌场工作人员的工资、购买赌具、为参赌人员提供香烟、茶叶等费用后，剩余股金用以与一般参赌人员进行对赌，故被告人刘某等人的行为应认定为开设赌场，其行为均构成开设赌场罪。</span></span></span></p><p style="margin: 0px 16px; padding: 0px; outline: 0px; max-width: 100%; font-size: 16px;">渔利，这是构成赌博罪的必要条件；而开设赌场行为，一般也是以营利为目的，但以营利为目的不是开设赌场的必要条件，即使行为人不以营利为目的的开设赌场也构成本罪；开设赌场的人是否直接参与赌博，以及开设赌场是否以营利为目的都不影响本罪的成立；二是，从犯罪场所的稳定和时间的长短来说，聚众赌博的场所随意性较大，通常具有不固定性，即聚众赌博的行为发生场所通常不固定，有的是在临时租赁、借用他人的房屋内或者自己家中进行，有的是临时在宾馆里开房进行，有的甚至在公共场所进行，一般时间也较短；而开设赌场为了吸引更多的参赌人员，赌博场所一般具有固定的营业地点和场所，其场所也相对稳定，持续时间也较长；三是，从赌博的规模和组织的严密性来说，聚众赌博一般规模较小，也没有很强的组织性；而开设赌场规模一般较大，其内部有严密的组织和明确的分工，有负责兑换筹码、记账、收费、发牌和洗牌、安保等人员；四是，从赌博场次的时间来看，聚众赌博的时间一般具有临时性、短暂性的特点，一般情况下，组织参赌人员在一次赌博结束后，下一次赌博又须组织者再次组织；而开设赌场的时间具有持续性和稳定性特点，即赌场在一定持续长的时间内连续、不间断地为赌博人员开放，只要在其开放时间内，赌博人员来到赌场均能进行赌博活动，而无须赌场经营者临时组织、通知；五是，从赌博的隐秘性来看，聚众赌博一般具有隐秘性，即组织者通常是在小范围内组织他人参赌，在每一次聚众赌博行为中其成员相对固定，其赌博行为一般只有组织者、参赌者和为赌博服务的人知晓；而开设赌场一般具有半公开性，即赌场开设的时间、地点、性质等被一定社会范围的公众知晓；六是，聚众赌博的赌头往往会利用其人际关系和人际资源来召集、组织每一次的具体赌博活动；开设赌场的经营者一般情况下不亲自参与召集、组织人员参与赌博。</span></span></p><p style="margin: 0px 16px;
